Floor Supervisors at the MGM Grand Casino Detroit were misclassified as exempt from the Fair Labor Standards Act (FLSA), according to a lawsuit filed in Michigan federal court. The lawsuit seeks unpaid overtime for work the employees regularly performed in excess of forty hours each week. The Floor Supervisors were paid straight time for all hours worked over forty and were required to attend pre-shift meetings and training session for which they were not compensated. Attorneys for the Floor Supervisors claim that the primary duty of the Floor Supervisor position is to perform non-exempt work such as monitoring game participation in accordance with MGM policies and practices, tracking significant player activity, rating players and reporting issues on the floor to the Pit Manager. The lawsuit alleges that the primary duties of the Floor Supervisors do not fall within any of the exemptions under the FLSA. Lawyers for the workers seek unpaid overtime, liquidated damages, pay for training the workers were required to attend, and attorneys’ fees.
