Cooks at Bully’s Sports Bar & Grill are suing the popular Nevada sports bar for overtime violations. According to the lawsuit filed in Nevada federal court, the bar misclassified its cooks as “exempt” under the Fair Labor Standards Act in order to avoid paying them overtime compensation. Attorneys for the cooks claim that Bully’s gave them the titles of “Kitchen Managers” and “Assistant Kitchen Managers,” even though their primary duty was to cook and clean only, and never directed nor supervised the work of others. Bully’s gave them these titles, according to the lawsuit, only to grant them “exempt” status, since under federal law, non-exempt employees must be paid overtime at the rate of one and one-half times their regular hourly rate of pay for all hours worked in excess of 40 hours per week. The lawsuit seeks to recover unpaid wages, unpaid overtime, damages, and attorneys’ fees.
